Competition Rules

Prepared by Worcester Photographic Club for Worcester Tourism Association (WTA).

OFFICIAL CONTEST RULES.
You retain all ownership rights in your photographs. We will not sell or redistribute your photos.
These Rules ask you to give WTA the right to display your work.
We want you to have the opportunity to display your work, but please, do not submit any photographs that belong to someone else or that infringe on anyone else’s rights. Thanks for your participation!

PLEASE REVIEW ALL OF THESE OFFICIAL RULES BEFORE ENTERING THE CONTEST.

1. General Conditions.
WTA’s photo contest (the “Contest”) is sponsored by GVC. (“Golden Valley Casino”). By entering the Contest, you agree to abide by the terms of these Official Rules and by the decisions of WTA relating to the Contest, which are final and binding in all respects. The Contest shall be governed by these Official Rules, and the laws of the RSA

2. Who Can Enter?
2.1 In order to enter you must be a natural person and be 14 years or older. If you are under the age of 18 you must have the permission of your parent or legal guardian and they must have approved of and consented to you entering the Contest, submitting your photograph, and being bound by the Official Rules applying to the Contest.
2.1 You may not enter or win if you are a professional photographer. You will be deemed to be a professional photographer if you make more than 50 percent of your income from photography.
2.3 You also may not enter or win if you are an employee of WTA or GVC, or, are an immediate family member or live in the household of any of the foregoing persons.

3. How Do I Enter a Photograph?
In order to enter a photograph in the Contest, you must:
3.1 Complete the Official Entry Form. The Official Entry Form will require you to enter your name and e-mail address and may ask for other information, such as title, brief description of the photograph and the context in which it was taken. You must provide all information requested on the Official Entry Form and comply with any technical requirements for submitting your photo(s), such as format and resolution.
3.2 Pay the appropriate entry fee of R15.00 (Fifteen Rand) per entry.
3.3 You may enter up to 5 (Five) photographs, but you will be required to submit each entry separately using an Official Entry Form for each entry.

4. What Photographs Can I Enter?
4.1 You may enter any of your original photographs, provided that you are the owner of all copyrights in the entered photograph.
4.2 Any photographs entered in the Contest by you must accurately and fairly depict the subject thereof, and must somehow promote Worcester.
4.3 You may enter images that combine the elements of more than one photograph, and photographs that have been digitally altered or manipulated are acceptable as long as they are factually true, and have been taken in Worcester or its environs.
4.4 You may not enter a photograph or description that contains any nudity, obscenity, defamatory statements, or other offensive or objectionable content.
4.5 Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest.
4.6 If your photograph does not meet all size, formatting, content and other specifications it will not be eligible to win.
4.7 Historical Black-and-White Photo's of Worcester and or landmarks are deemed eligible for this competition, although it should be digitalized by a photo-laboratory (Kodak Express Superfoto in the Mountain Mill Mall), for the purposes of this competition.
4.8 By entering a photograph in the Contest, whether or not it is eligible to win, you also are submitting the photograph and its accompanying description to WTA and in particular, in, you will be granting WTA a royalty free, world wide non exclusive, non terminable, perpetual license to display your photograph on any promotional material. 4.9 You, however, will retain ownership of all copyright in your photograph.

5. Until When Can I Enter?
The Contest will run from 21 November 2011 until 27 April 2012. You must enter your photo(s) before that date. If you attempt to enter a photograph after that date, it will not be eligible to win.

6. When Will Winners Be Announced?
Winners will be chosen by 3 independent judges and to be announced on a date confirmed on Worcester Tourism Association's web site. These photographs will be displayed at a function to be held at Golden Valley casino, mid-May 2012.

7. What Prizes Will Be Awarded?
A] The following main prizes will be awarded :
First Prize – R5,000-00 (Kodak Superfoto Voucher)
Second Prize – R3,000-00 (Voucher)
Third Prize – R1,000-00 (Voucher)

B] Top 10 Photo’s
The top ten photo entrants to be used for postcard prints and photographers to be recognized on back of postcard. This will be the property of the Worcester Tourism Association and winners will not be compensated for these photos, as per 4.7.

C] Spot Prizes:

The WTA, however, reserves the right to substitute prizes of equal or greater value. In addition, all prizes are non exchangeable, non transferable and non redeemable for cash. No substitutions are allowed.

8. How Will My Photograph Be Judged?
8.1 All eligible photographs entered in the Contest will initially be judged by 3 independent judges with photographic backgrounds, based on
promotional value
emotional impact,
photographic quality (factors such as composition, perspective, exposure, and lighting that evidence technical skill in taking and editing of the photograph), and
the clarity, accuracy, and impact of their accompanying description.
8.2 These judges also may take into consideration any other factors which they deem appropriate. These judges will chose 20 entries as finalists.
8.3 The 20 finalist entries will be judged by 3 independent persons, whose discretion is absolute.
8.4 All evaluations of eligible photographs and the application of those factors shall be conducted by the initial 3 and the final 3 judges in accordance with their sole discretion and judgment. Decisions in selecting the winning photographs will be final.

9. What Happens If I Am A Winner?
9.1 All prospective winners (finalists) will be notified by e-mail before the 6th of May 2012. If you are a prospective winner, you will be required to confirm your identity and the other personal information you provided when you entered and to confirm your agreement to all terms and conditions of the Contest.
9.2 You will be asked to submit your relevant entry in format, as determined by judges (RAW/TIFF/JPEG) within 14 (fourteen) days.
9.3 In addition, you may be required to confirm or provide additional details concerning the circumstances under which your photograph was taken and to provide proof of ownership and releases from any identifiable persons depicted in the photograph.
9.4 Any requested information and confirmation must be provided within 14 (fourteen) days of request. You also understand that if we contact you as a prospective winner or request further information or confirmation from you, that does not mean that you will be declared a winner or awarded a prize. If you are an actual winner or will be awarded a prize, you will be notified as such by e-mail, unless you are present at the award function.

10. What Am I Agreeing to By Entering a Photograph?
By entering the Contest you represent and warrant to WTA that:
10.1 You meet all eligibility requirements of the Contest;
10.2 All information provided and representations made by you in entering the Contest are true and correct;
10.3 That you have and will comply in all respects with these Official Rules; and
10.4 Any photographs entered by you consist entirely of your own original work in which you hold all necessary rights, including rights of publicity.
10.5 By entering the Contest you also acknowledge and agree that WTA may use your entry for purposes of advertising, trade, and promotion for display, digitally and/or in print, whether or not you win a prize, as long as you are recognised as the photographer in such display.
10.6 By entering the Contest, you also release and hold harmless WTA, its officers, directors, employees, agents, and representatives from any and all damages, losses, liabilities, costs, or expenses of any kind arising out of or resulting from:
10.7 Any violation by you of these Official Rules (including the Policies, and all statutes, orders, regulations, and other laws applicable to the Contest);
10.8 The Contest, your entry in the Contest, or photographs entered in the Contest;
10.9 Your acceptance, possession, receipt, or use of any prize;
10.10 Any incorrect, incomplete, or garbled information caused by any technical or human error that may occur in the operation of the Contest, including without limitation printing or typographical errors in any Contest materials;
10.11 Any problems or technical malfunctions (errors, omissions, interruptions, deletions, defects, or delays in operation or transmission) of any computer, telephone, modem, online system, server, or other communications equipment or provider;
10.12 Any failure of e-mail on account of Internet traffic congestion or otherwise (proof of transmission does not constitute proof of delivery); and
10.13 Any entry, e-mail, or other material or correspondence that has been tampered with or that is stolen, misdirected, incomplete, lost, late, nonconforming, ineligible, or damaged.
ALL PRIZES ARE GIVEN PRESENTED BY WTA "AS IS." WTA DOES NOT MAKE AND HEREBY DISCLAIMS ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY (INCLUDING WITHOUT LIMITATION IMPLIED AND STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NO INFRINGEMENT), WITH REGARD TO ANY PRIZE(S) OR PORTION(S) THEREOF.

11. Submission Procedure
11.1 The photo/the photos, entry form and “Proof of Payment” must be submitted electronically as an attachment to an email and sent to the photo contest coordinator superfoto.cw@mweb.co.za by 27 April 2012 @ 17:00.
11.2 The entries must be sent as a jpg-file, the size must be 13 cm x18 cm at 300 dpi.
11.3 The size of the file should not be larger than 1MB.
11.4 Please send one email per entry to avoid transmission problems.
11.5 A reply email confirming receipt will be sent immediately. If you do not receive a response, please contact the coordinator to make sure that the entry arrived.
11.6 The name, address, email address and telephone number of the entrant must be provided in the email to which the photograph is attached:

12. What Happens If We Have A Dispute Over the Contest?
The administrators of this competition undertake to respond to any issues you may have in good faith and in a professional manner so that, if possible, they can be resolved to our mutual satisfaction through informal communications. If we are unable to resolve any issues between us on an informal basis, however, this Agreement provides that all disputes between you and us will be resolved by ARBITRATION. You cannot go to court to resolve any disputes we may have, and instead must go to arbitration. Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or magistrate. You are entitled to a FAIR HEARING, BUT the arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT. For more details, please see the paragraphs that follow.
Any dispute between you and WTA arising out of or relating to the Contest, these Official Rules , or any prize shall be governed by and construed in accordance with the laws of the RSA. The venue for any arbitration proceeding arising out of or relating to this Agreement, or civil actions, claims, or disputes relating to this Agreement, shall take place exclusively in Worcester. Any and all civil actions, claims, disputes or proceedings arising out of, or relating to, this Agreement shall be referred to final and binding arbitration, before a single arbitrator, under the arbitration rules of Equillore. Arbitration shall not commence until the party requesting it has deposited Two Thousand Rand (R2,000.00) with the arbitrator as a retainer for the arbitrator's fees and costs. The party requesting arbitration shall advance such sums as are required from time to time by the arbitrator to pay the arbitrator's fees and costs until the prevailing party is determined or the parties have agreed in writing to an alternate allocation of fees and costs. If any part of these Official Rules is held to be invalid, illegal, or otherwise unenforceable, such part will be modified to the minimum extent necessary to make it enforceable while preserving to the maximum extent possible the original intent of WTA, and the remaining parts of these Official Rules will remain in full force and effect.
